Israeli cabinet resolves to continue the Gaza operation

On Day 5 of the Gaza operation, prime minister Ehud Olmert said: "Israel held back for years and finally decided to try a ceasefire. But it was violated by Hamas." His office said the French 48-hour truce idea was not on the table. There are others, Olmert said, but none are realistic enough to discuss. If conditions change and a solution that guarantees a better security situation in southern Israel comes up, we will reconsider. But we are not there yet.
Nevertheless, foreign minister Tzipi Livni travels to Paris Thursday, Jan. 1, ahead of French president Nicolas Sarkozy's visit to Israel next Monday.

Hamas broadens rocket scope to Gedera Wednesday, firing every few minutes

An improved Grad rocket landed on open ground in the Yoav Council region, location of the towns of Beersheba, Kiryat Malachi, Ofakim and Netivot as well as Kiryat Gat, the only town not targeted by a Hamas rocket so far. But the Lachish region east of Kiryat Gat was.
Gedera, some 35 km from the Gaza Strip, reported a hit later. On Day 5 of the Gaza conflict, Wednesday, Dec. 31, Hamas loosed a massive hail of rockets and missiles every few minutes. They claimed 9 Grad rockets had been fired. DEBKAfile's military sources attributed the clear signs of Hamas recovery to three causes:
1. Heavy rain and mist over the region which limited visibility and inhibited Israeli air force action against missile sites in Gaza.
2. Hamas had restored its chain of command for organizing and directing missile squads and stepping the tempo of launches. Its leaders are still hiding underground.
3. By Tuesday, Hamas had managed to transport large quantities of missiles from underground caches to firing positions near the Israeli border.
Belatedly, by Tuesday night, the Israeli war command appreciated its error in omitting to launch the IDF ground operation Monday, Day 3 of the Gaza offensive. Instead of opening up then with a limited incursion that would evolve into a broad ground operation, Israeli leaders wasted precious time in futile discussions on international demands for a ceasefire, which had no chance of holding up. Defense minister Ehud Barak, instead of running the war, spent hours on the phone with French foreign minister Bernard Kouchner, before he, prime minister Ehud Olmert and foreign minister Tzipi Livni, finally agreed that the French 48-hour truce proposal was unrealistic.
Now, Israeli tanks and armored forces will have to wait for the weather to clear while watching Hamas broaden its swathe of attacks.
Wednesday, Hamas fired 35 missiles and rockets in two and-a-half hours, striking targets in an area that stretched from relatively near locations like Sderot, Shear Hanegev and Ashkelon, to the farther 40 km-extremity of Beersheba, Ashdod, Yavne, up to the outer limits of the Yoav Council and finally Gedera.
DEBKAfile's military sources report that Hamas is suspected of having acquired rockets with a range of 50-55 km, bringing them ever closer to central Israel. They estimate that Hamas is holding this weapon in reserve for the potential Israeli ground incursion into the Gaza Strip. It is also disclosed that the Israeli air force mounted its second attack on the Philadelphi border zone's smuggling tunnels Tuesday, Dec. 30, after learning that Hamas had repaired some of the 40 tunnels first bombed Sunday.
The Air Force has revised its estimate of the quantity of Hamas missile stocks destroyed down from 50 percent to 10-15 percent. This means that their remaining stock is more like 8,000 than 6,000, including at least 100 long-range extra-punch Grad rockets. They can therefore keep up a high level of firing for around 80 days.

Israeli F-16 bombers have pounded targets across the Gaza Strip, killing more than 200 people, according to local medical workers.
Most of those killed were policemen in the Hamas militant movement, which controls Gaza, but women and children also died, the Gaza officials said. About 700 other people were wounded.

Day 5 of Gaza operation: Beersheba under intensive Hamas rocket attack. Hotel on fire

Contrary to previous report, the hotel fire was not caused by the fifth improved Grad rocket which hit Beersheba Wednesday, Dec. 31, on Day 5 of the Israeli operation against Hamas.
Four Grad Katyushas exploded in built-up areas. One dropped through the ceiling of an empty classroom, others exploded near an apartment building and one on empty ground outside the city. Twenty-one shock victims were hospitalized.
Beersheba's 250,000 citizens were ordered to shelter in solid buildings and schools shut until further notice. So too for the first time were the people of Omer and Hatzerim. Beersheba University has suspended studies. Missiles also struck Netivot, Ofakim,Yavne, the Eshkol farming district and Sderot, causing damage and light injuries.
Altogether 200,000 children in the areas targeted by Hamas are prevented from attending school. Local radio stations update Homeland Command directives to residents in several languages - including Russian and Amharic for new immigrants.
Beersheba is the largest town and the most distant, 40 km from Gaza, ever to come under rocket attack. The first two rockets were fired Tuesday night, Dec. 30. They sent 54 people in shock to hospital, half of them children, and damaged an empty nursery school.
Tuesday, as Palestinian missile and rockets against several Israeli towns and villages mounted to 50, Israel called up another 2,500 reservists and its military spokesman denied any recommendation to accept a 48-hour ceasefire.
The call-up order raised the number of reservists Israel has mobilized for the Gaza operation to 9,200. Israeli tank, infantry, armored and artillery units are massed outside the northern, central and southern Gaza Strip awaiting orders to go in.

Eligibility case finds 'standing'?
New suit claims unique state law enables citizens to demand proof

A new case challenging Barack Obama's natural-born citizenship and, therefore, constitutional eligibility to serve as president has the potential to clear a hurdle that caused several other similar cases' dismissal: the issue of "standing."
In the case brought by Pennsylvania Democrat Philip Berg, for example, a federal judge ruled against the lawsuit in deciding Berg lacked the "standing" to sue, arguing that the election of Obama wouldn't cause the plaintiff specific, personal injury.
In Washington state's Broe v. Reed case, however, plaintiff's attorney Stephen Pidgeon says a unique state statute grants everyday citizens the required standing.
"These lawsuits have pointed their fingers at the various secretaries of state and said, 'You handle the elections, it's your job [to verify Obama's eligibility],'" Stephen Pidgeon told WND, "and the secretaries of state have said, 'No, it's not our job. You the voter have to prove he was ineligible.' But when the voters try to do it, the courts tell them they have no standing. So it presents a catch-22.
"Here, we have standing by means of statute," Pidgeon continued. "This particular statute provides for any registered voter to challenge the election of a candidate if the candidate at the time of the election was ineligible to hold office."
Further, Pidgeon explained, "In Washington we also have a constitutional clause in Article 1 that says the U.S. Constitution is the supreme law of land, so it's very much a state issue that the secretary of state has a duty to enforce the U.S. Constitution.
"He doesn't think he does; we think he does. That's really the issue before the court," Pidgeon said.

A lawyer who already has two conferences pending before the U.S. Supreme Court on the issue of Barack Obama's eligibility to be president has filed a new lawsuit, this one on behalf of a retired military colonel who would need to know whether to follow any orders issued by Obama as commander-in-chief.
Philip Berg's earlier case and a request for an injunction in the case are scheduled for conferences with the justices on Jan. 9 and Jan. 16.
The new case, filed with co-counsel Lawrence J. Joyce, was submitted to U.S. District Court in Washington, D.C., and names as defendant "Barry Soetoro a/k/a Obama."
It demands to know Obama's real name and his constitutional qualifications to occupy the Oval Office. The plaintiff is Gregory S. Hollister, a resident of Colorado Springs, who has "standing" and "needs a decision so he knows whether or not to follow any order of Soetoro a/k/a Obama."
Berg reported the case is in the nature of an interpleader, shifting the burden of proof to Obama and Joe Biden.
"I am determined, on behalf of the 320 million citizens in the United States, to see that 'our U.S. Constitution' is followed. Specifically, in the case of Soetoro a/k/a Obama, does he meet the constitutional qualifications for president?" Berg said.

Thousands signing petition to pardon Border Patrol agents

WASHINGTON – More than 26,000 people want President Bush, in the few days left of his presidency, to take action to free imprisoned Border Patrol agents Ignacio Ramos and Jose Compean, and have signed a petition seeking freedom for the two that is part of a campaign launched by WND Editor Joseph Farah.
"I am calling on President Bush to do the right thing before he leaves office Jan. 20," said Farah. "These are the pardons or sentence commutations the American people want to see more than any other. We don't want to see any more drug dealers freed. We don't want to see any other millionaires get pardons. We don't want to see any other well-connected crooks have their sentences overturned. We want to see Ramos and Compean out and their reputations restored."
Ramos and Compean are serving sentences of 11 and 12 years respectively for the shooting of an illegal alien drug smuggler in the line of duty. The drug dealer received only minor injuries and was given full immunity from prosecution by the federal prosecutor in return for his testimony against the agents.
