An Ohio State University associate professor who includes election law among his specialties says there is a logical legal strategy to convince the U.S. Supreme Court to rule on the issue of Barack Obama's eligibility to be president.

Daniel Tokaji, in an interview with WND, confirmed the thesis of a "First Impressions" column he'd written for the Michigan Law Review that a lawsuit in a state court probably would have the best chance at success in obtaining a decision.

WND has reported on dozens of legal challenges to Obama's occupancy in the Oval Office based on questions over his "natural born citizen" status. The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the lawsuits question whether he actually was born in Hawaii, as he insists. If he was born out of the country, Obama's American mother, the suits

contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

This statement by a senior American official amounts to Washington's endorsement of Israel's presumed nuclear capability as long as Iran persists in continuing to enrich uranium in defiance of UN Security Council resolutions, DEBKAfile's political sources report.

It removes a major obstacle clouding White House talks next Monday, May 18, between Israeli prime minister Binyamin Netanyahu and president Barack Obama and paves the way for an Israeli request to extend the 40-year old "ambiguity" arrangement approved by Obama's predecessors.

The senior US official, who spoke in Vienna on condition of anonymity, was addressing preparatory talks for a nuclear non-proliferation treaty review conference in 2010 Friday night, May 15. He made it clear that US arms control negotiator Rose Gottermoelle did not break new ground last week when she urged presumed atomic powers India, Israel, Pakistan and North Korea to join the nuclear non-proliferation pact.

The US official said Friday: The four were unlikely to join the NPT "until there is a change in the overall political and security context." He added: "In the particular case of the Middle East, Israeli adherence to the NPT is only going to be possible in the context of… full compliance with [the treaty in the region]." Establishing a Middle East nuclear weapons-free zone "depends on Iran fully complying with its NPT obligations and suspending uranium enrichment."

This statement eased concerns in Jerusalem that as part of his drive for global nuclear disarmament, President Obama would insist on Israel leading the way to win a bargaining chip in his forthcoming diplomatic negotiatons with Tehran. This would have terminated the informal longstanding deal between Jerusalem and US presidents allowing Israel to refrain from admitting or denying possession of a nuclear arsenal while maintaining the status of a nuclear power in relation to its enemies.

At the Vienna meeting, the five major UN powers welcomed the decision by the US and Russia to negotiate an updated version of the 1991 Strategic Arms Reduction Treaty (START). Their officials meet in Moscow next week.

James Dobson, the founder of the Colorado Springs-based Focus on the Family Christian ministry, warned today that there is "utter evil" coming out of Washington, D.C., these days.

"I want to tell our listeners something has come up that is so shocking and so outrageous, we must make our friends out there aware of it," he said on his daily radio program.

"I'm going to speak very bluntly today because there's no other word for it: the utter evil that's coming out of Congress," he said. "I've been on the air 32 years and I've never seen a time quite like this.

"The radical left controls the executive branch through the president, and the Congress where the Democrats have control of both the House and the Senate," he said, adding the courts are expected to move even further to the left.

The target of his worry is the so-called "Hate Crimes" already approved in the U.S. House and now pending in the Senate.

Akers, policy analyst with Liberty Counsel, as a bill to create penalties against "victims" who were chosen based on an "actual or perceived ... sexual orientation, gender identity."

Speaker Pelosi's press conference yesterday had to rank as one of the most bizarre political implosions since Richard Nixon's infamous "I'm not a crook" press conference in April 1974.

Pelosi called the press conference to offer her fifth separate explanation for why she never knew about the application of so-called "enhanced interrogation techniques" despite the release of CIA memos and the recollection of other participants who clearly recall her being extensively briefed.

As press conferences go, it was painful to witness. Noted one observer, if Pelosi was not lying, she deserved an Academy Award for appearing as though she were. When questioned by reporters, she actually re-read her prepared statement – several times – stumbling over it as if she were cold-reading the description of an event involving someone else.

The conference was, as noted, bizarre to the point of being surreal. If it weren't the person who stood third in line for the Oval Office speaking, it would have been almost funny.

Indeed, it had all the elements of a "Saturday Night Live" skit, right down to the indescribably awkward moment when a reporter, clearly planted by Pelosi's handlers, tried to change the subject by asking a softball question about health care. (The question was so obviously a plant that the other reporters actually booed him.)

Let's back this up and look at where it all began. On Sept. 11, 2001, 19 hijackers murdered 3,000 innocent Americans, destroyed two 110-story buildings, four commercial aircraft, damaged the Pentagon and practically tanked the U.S. economy. They then promised that this was only the first wave of many similar attacks to come.

The Bush administration vowed to do whatever was necessary to protect Americans from further attack. Whatever necessary includes a practice known as "waterboarding." Waterboarding is a practice that simulates drowning, terrifying its victim but causing no injury or permanent damage.

It is routinely employed against U.S. Special Forces as part of their training. The CIA says it briefed Nancy Pelosi of its use against Abu Zubayda back in August of 2002. Now, in 2009, waterboarding is officially torture, and Nancy Pelosi wants to go after members of the Bush administration for using it, even though it was legal at the time.

But, if Pelosi knew about it in 2002 and said nothing, then any investigation would ultimately result in her silence, making her complicit in the "crime." The issue of what she knew and when she knew it became a very inconvenient line of questioning for her. So she lied and said nobody told her.

In the most recent reincarnation of the story, she argued that her job was really to take over Congress and get a Democratic president elected, and she was therefore much too busy to conduct public policy. And so that's why nobody told her.

One wonders what can possibly be motivating the speaker, apart from what one could only term a pathological sense of vindictiveness. Raising the issue accomplishes nothing to benefit the Democrats. Like the speaker, they knew and did nothing.

Or they arranged not to know and therefore do nothing. Or, like Sen. Chuck Schumer, they signed off on it, telling the CIA to "do what it has to do" to keep America safe.

Bringing it up again at this juncture doesn't do much harm to the Republicans now in office. They've already lost the White House, both Houses of Congress and are so hopelessly outnumbered as to be unable even to slow down the Democratic agenda.

Yad Vashem speech disappoints those hoping for an expression of remorse.

As a Bavarian youth, Joseph Ratzinger grew up in Adolf Hitler’s shadow. He was 6 years old when Hitler rose to power. He was 11 during Kristallnacht, when brown shirt Nazis attacked the homes of several Jewish residents living in his hometown of Traunstein, a small city of less than 12,000 residents. At the age of 14, when it was made compulsory, Ratzinger became a registered member of Hitler Youth. At 16, he was drafted into the antiaircraft corps of the German Army, where he served for two full years before he “fled” for the seminary as the war drew to a close.

Against this backdrop, it’s no wonder Ratzinger’s every word was so carefully scrutinized on Monday, when the German pope delivered his much-anticipated speech at Jerusalem’s Holocaust memorial.

“I have come to stand in silence before this monument, erected to honor the memory of the millions of Jews killed in the horrific tragedy of the Shoah,” Pope Benedict xvi said, stopping way short of actually apologizing—an audacious omission, when you think about it, given the fact that he is a German-born pope who fought on the wrong side of history.

His failure to assign blame, let alone accept any, angered many Israelis.

“There certainly was no apology expressed here,” said Holocaust survivor Yisrael Meir Lau, the chairman of the Yad Vashem Council. “Something was missing. There was no mention of the Germans or the Nazis who participated in the butchery, nor a word of regret,” Lau told the Jerusalem Post. “If not an apology, then an expression of remorse.”

Visiting Yad Vashem does not, in itself, constitute an expression of regret, Knesset Speaker Reuven Rivlin said during an interview the day after the pope’s remarks: “I came to the memorial not only to hear historical descriptions or about the established fact of the Holocaust. I came as a Jew, hoping to hear an apology and a request for forgiveness from those who caused our tragedy, and among them, the Germans and the church. But to my sadness, I did not hear any such thing.”

The official Vatican spokesman, Federico Lombardi, rushed to Ratzinger’s defense, telling a group of reporters in Jerusalem that the pope cannot be expected to repeatedly draw attention to his German roots “every time he speaks.”

But if ever there was a time to repeat it, wouldn’t it be at Yad Vashem?

Lombardi then inexplicably claimed that Benedict “never, never, never” was a member of the Hitler Youth. With a subject that sensitive, he said, “It is important to say what is true and not to say false things.” He later retracted his initial comment, admitting Ratzinger was a reluctant member of the Hitler Youth.

This isn’t the first time the Vatican has hurriedly assembled a response to criticism leveled at Benedict for his wartime record and his present-day unwillingness to offer any kind of apology to the Jews. During his 2006 speech at Auschwitz, the pope made no mention of anti-Semitism or of German culpability for the Holocaust. In 2007, the pope angered Jews worldwide with his call for them to be converted to Catholicism. And earlier this year, the pope again came under intense fire for lifting the excommunication of an outspoken bishop who happens to be a Holocaust-denier.

Then there is Benedict’s defense of Pope Pius xii, the World War ii-era pope who, prior to his pontificate, successfully negotiated the Reich Concordat with Adolf Hitler in 1933, effectively destroying all political opposition to the fledgling Nazi movement in Germany. According to cabinet meeting minutes from July 14, 1933, Hitler considered the German-Vatican pact a “great achievement”—particularly “in the developing struggle against international Jewry.”

Years later, as pope, Pius xii became well aware of Hitler’s Final Solution. Throughout 1942, Jewish groups and Allied officials had repeatedly urged him to publicly condemn the Nazi savagery. Under increasing pressure, Pius used a December 1942 radio address to refer to the many thousands who “sometimes only by reason of their nationality or race are marked down for death or gradual extinction.” Pius’s strongest objection to Hitler’s genocidal rampage failed to even mention the Führer by name and drew no reference to Nazis or Jews.

In October 1943, ten months after Pius’s radio address, 365 of Hitler’s SS troops entered Rome’s old ghetto and started arresting Italian Jews. They rounded up 1,060 and transported them to a building called Collegio Militare—located less than half a mile from the Vatican. Pope Pius was one of the first to be made aware of the Jewish arrests. The Jews were kept at the holding center for two days—right under the pope’s nose—before boarding cattle cars to Auschwitz, where 80 percent of them were gassed within a week.

During the Jews’ two-night confinement down the street from the Vatican, Pope Pius xii did nothing.

Last September, Pope Benedict xvi defended his World War ii-era predecessor against critics who say the Vatican turned a blind eye to the Holocaust. Incredibly, Benedict praised Pope Pius xii for his courage in trying to save Jews. “Wherever possible he spared no effort in intervening in their favor either directly or through instructions given to other individuals or to institutions of the Catholic Church,” Benedict said.

This simply does not square with an honest reading of history, which is why Benedict will not allow public access to the Vatican’s carefully guarded archives. Even still, there is plenty of evidence already accessible, both historically and prophetically, to those in search of truth.

Even at Yad Vashem, one exhibit inside the museum sums up the Vatican’s complicity in the Holocaust with this inscription: “When Jews were deported from Rome to Auschwitz, the pope did not intervene.”

As it happens, this is the same pontiff Pope Benedict xvi will one day beatify, which is why Benedict insisted on making his unapologetic remarks at the Yad Vashem Memorial on Monday, as opposed to the museum.

He refused to set foot inside the museum.

Also, we should forget that Ratzinger’s Wehrmacht unit shot at Allied pilots over Germany. We are to supposed to believe that Ratzinger didn’t really mean to hurt anyone.

JERUSALEM – The Palestinian Authority exploited Pope Benedict XVI's visit here this week for political gain and to wage propaganda attacks against Israel, particularly regarding sovereignty over Jerusalem, according to a study released yesterday.

"The PA has exploited Benedict's visit to Israel ... especially the sensitive [issue] of sovereignty over Jerusalem. According to PA-affiliated spokesmen, Israel's presence in eastern Jerusalem does not give it sovereignty or any other rights," states a report by the Terrorism and Information Center at Israel's Center for Special Studies.

Reuven Erlich, the center's director, said the purported exploitation by the PA extended to the pope's tour of Bethlehem yesterday.

"The pope was deliberately paraded in front of the security barrier to make a non-issue into an issue. Also [PA President] Mahmoud Abbas used his speech alongside the pope for pure propaganda purposes," said Erlich.

Fox News' Glenn Beck may have uncovered another twist to a series of ACORN's alleged scandals when he revealed on his show that the group's main affiliate is operating out of a former New Orleans funeral home and bringing in millions of taxpayer dollars.

The Service Employees International Union's New Orleans headquarters location that also houses ACORN is supposed to be home to more than 270 related corporations and non-profits.

"Does that former funeral home look big enough to you to house 270 organizations?" Beck asked. "The owner of the building is a company whose partners are – oh my gosh! – Wade and Dale Rathke."

Wade Rathke, a New Orleans resident, is founder of ACORN and also founder and chief organizer of Service Employees International Union, which donated $33 million to President Obama's campaign last year.The online estimates Obama's entire campaign spending at about $640 million.

According to the New York Times, he failed to notify police in 2000 when he learned that his brother Dale, ACORN's chief financial officer, had embezzled $948,600 from Citizens Consulting Inc., the ACORN affiliate that handles its financial affairs.

Beck said Wade and Dale are listed as president or partner in dozens of companies based in the New Orleans building.

"[T]he big question remains unanswered: Millions of dollars flow into that building every year," Beck said. "Where does it go?"

He said ACORN received as much as $10 million in federal grants last year. But it could get up to $8 billion more after the House passed Rep. Barney Frank's amendment allowing organizations indicted for voter fraud or related crimes to receive taxpayer dollars today.

Rep. Michele Bachmann, R-Minn., urged Congress to block ACORN's access to federal housing funds.

"ACORN, as you know, is no stranger to the spotlight," Bachmann said outside the Capitol. "Yet no matter how many times prosecutors investigate and even indict ACORN and their employees, they emerge unblemished as far as the federal government is concerned from having access to federal tax dollars."

Bachmann told Fox News that ACORN has received at least $53 million in tax dollars since 1994. Frank's amendment passed by a vote of 245-176, largely upon party lines.

"I am disappointed that Congress decided to side with ACORN today over the taxpayers," Bachmann said. "It is not only legitimate for Congress to decide the threshold for accessing taxpayer funds; it is incumbent upon us to do so. And, for far too long, Congress has cavalierly distributed taxpayer money. … This is a shameful abdication of our fiduciary duties."

Thirty years ago, at the end of 1978 and beginning of 1979, US President Jimmy Carter’s blind approach and his obsessive concern for human rights everywhere, and particularly in the Shah-ruled Iran, prompted Khomeini’s rise and brought Khomeinism to power. Carter did not permit the Shah to handle the protests against him, that is, to disperse them with gunfire. The result was the ayatollah takeover of Iran and the murder of thousands of Shah supporters. Everything the world suffered, is suffering, and will suffer because of Iran is the direct result of the short-sightedness of an American president who understood nothing in the ways of the Middle East.

A Virginia congressman, very quietly, has signed onto a measure in Congress that would require presidential candidates to verify their eligibility to hold the highest elected office in the United States.

WND earlier reported when freshman Rep. Bill Posey, R-Fla., filed H.R. 1503, an amendment to the Federal Election Campaign Act of 1971.

According to the Library of Congress' bill-tracking website, H.R. 1503 would "require the principal campaign committee of a candidate for election to the office of president to include with the committee's statement of organization a copy of the candidate's birth certificate, together with such other documentation as may be necessary to establish that the candidate meets the qualifications for eligibility to the Office of President under the Constitution."

CIA Director Leon Panetta - a quiet visitor

Director of the US Central Intelligence Agency Leon Panetta visited Israel two weeks ago to explore Israel's intentions with regard to a raid on Iran's nuclear facilities and its alignment with Egypt and Saudi Arabia for this shared objective.

On the one hand, Panetta showed Israeli leaders with a new US report which estimates first, that Iran lacks adequate military resources to shield its nuclear sites from attack and, second, would pull its punches in responding to an Israeli strike. On the other, it is feared in Washington that by linking up with Egypt and Saudi Arabia, Israel would be free to send its warplanes against Iran through the skies of its two Arab partners, without deferring to the United States.

(This potential partnership was first disclosed in detail by DEBKA-Net-Weekly 395 of May 8).

This report was also presented by defense secretary Robert Gates on May 5-6 to Egyptian president Hosni Mubarak in Cairo and Saudi King Abdullah in Riyadh.

None of the three Middle East leaders took the report seriously because -

1. They could not make out if it was meant to encourage or deter an Israeli attack? Surely, the best time to strike would be before Iran acquires adequate defenses for its nuclear sites. Is that what the Obama administration is after?

2. Israel does not believe that Iran would emulate Iraq's Saddam Hussein who refrained from hitting back after Israel demolished his nuclear reactor in 1981. Iran's rulers are committed to massive retaliation or else face a degree of popular contempt that would test the regime's survival.

Panetta and Gates alike returned home convinced that Israel, Egypt and Saudi Arabia and other Gulf emirates are far more fearful of a nuclear-armed Iran than of clashing with the Obama administration over its policy of engaging Iran.

This understanding prompted a policy review in Washington, which is still going on.

One outward symptom of a possible reversal was the sudden announcement on May 8 that President Obama had decided to again address the Muslim world from Egypt on June 4, ten days after Mubarak visits Washington. On the same day, he also renewed sanctions against Syria, which, after weeks of diplomatic pursuit, he accused of sponsoring terror and seeking weapons of mass destruction.

Washington's dawning appreciation that the rise of a nuclear-armed, terror-sponsoring Iran is the burning preoccupation of Middle East rulers, leaving the Palestinian issue for another day, will certainly make Israeli prime minister Binyamin Netanyahu's talks in the White House next Monday, May 18, a lot smoother. The clash which otherwise would have been unavoidable may now be averted.


Israel: Why the Two-State Solution Will Not Work

The State of Israel was born 61 years ago today. Israel’s delivery was not without complication and drama. For months, the life of the newborn state hung in the balance, under constant threat from and at a significant strategic disadvantage to the Arab armies that surrounded it on three sides. Miraculously, Israel survived. Victorious and worn out, yet still independent, Israel remained imperiled and strategically disadvantaged for the next 19 years.

Until June 1967.

It’s hard to exaggerate the extent to which the Six Day War assured Israel’s future existence as an independent state. The war only lasted 130 hours and 50 minutes—during which Israel beat back the advancing armies of Arab states, decimated the air forces of Egypt and Syria, wrested the Golan Heights from Syria and gained control over the entire Sinai Peninsula. But it had a defining impact on Israel’s sovereignty.

How? On June 5, not long after Israel had begun its preemptive defensive strike on Egypt, it was forced into confrontation with Jordan. Seeing opportunity, the Jordanian military had started firing on Jerusalem, moved forces into Jerusalem (where it overran the United Nations headquarters) and begun firing on Jewish cities on the coastal plain from its position in the hills of what it termed the West Bank. Finally, after Jordan rejected a UN ceasefire agreement, Israel pursued its only remaining option.

On June 5, the Israeli military annihilated the Jordanian Air Force. By the 8th, Israel’s military had pushed the Jordanian military out of the West Bank and back over the Jordan River. Israel’s only option had been to retake Judea and Samaria!

Armstrong College recently, former Israeli Ambassador Yoram Ettinger explained the significance of Judea and Samaria to Israel’s independence and national security. Judea and Samaria are the “crux of the cradle of Jewish history,” Ettinger explained. Israel does not exist on the eastern flank of the Mediterranean because of Tel Aviv or any of the coastal cities. Instead, Ettinger said, the essential reason Israel exists today is because of the “territorial stretch between Hebron in the south, the first Jewish capital before Jerusalem, and Nabulus in the north, the first stop of the Israelites when they reentered the Promised Land.”

Judea and Samaria is the heartland of the Jewish people, Ettinger said, and a strategic necessity for preserving the independence of a Jewish state!

The Jewish people have been tethered to Judea and Samaria for more than 3,000 years. Genesis shows that Abraham entered Israel through Shechem, and that the hills of Judea and Samaria were the stomping grounds for his descendants through Isaac and Jacob. The Bible records that Abraham, Isaac and Jacob were buried in Hebron, a bustling city in the Judean hills. Even Joseph, although he lived and died in Egypt, was buried in Shechem, in the hills of Samaria (Joshua 24:32). Scripture says Bethel, known today as Beit El, was where Jacob slept on the pillar stone and had his famous dream. The book of Exodus shows that the ark of the covenant, before being placed in the temple in Jerusalem, rested in the Samarian city of Shilo.

The Jews’ fingerprints are literally all over the hills of Judea and Samaria. “Ninety-two percent of the Bible place names are in the mountains of Israel in what the Bible calls Judea and Samaria and the world calls the West Bank,” says Billye Brim, a Bible scholar at Elon Moreh. In the book of Joshua, God maps out the borders of the Promised Land as a whole, as well as the internal borders separating the 12 tribes of Israel. In Joshua 15, God specifically outlines the territory assigned to the tribe of Judah, of which the Jews today are descendants. Notice, God placed the tribe of Judah at the heart of the Promised Land, on the northwest side of the Dead Sea, and primarily in the hills of what even today is still called Judea!

As the biblical heartland of the ancient Israelites (of whom the Jews are descendants today), the territory of Judea and Samaria—not the Golan, not the coastal plain—is the pulse of Jewish sovereignty. This history definitely complicates land-for-peace deals and the two-state “solution.” But as Ettinger asked: “Can any nation survive whilst negotiating away the cradle of its history? … If you don’t have your roots, how can you have peace?” Trees will not blossom without strong roots, and will more than likely be uprooted by the lightest wind.

The same applies to Jewish national sovereignty, which is rooted in Judea and Samaria.

There’s another reason Judea and Samaria are critical to Israel’s independence. Geographically, this
territory is largely comprised of a mountainous ridge, known as the spine of Israel,

that stretches from below Hebron in the south to the valley of Jezreel in the north. These hills, ranging from 2,000 to 3,000 feet high—the “mountains of Israel” as they are referred to in the Bible—provide an ideal strategic vantage point for either engaging with enemies or simply standing guard over the towns and cities peppered across the lower plains. The scraggy hills, marked by steep inclines, gaping gorges and deep valleys, are also an ideal natural barrier for slowing invading armies, and provide a measure of protection for civilians and homeland armies as well as military hardware and facilities.

Many are aware that the Golan Heights provide Israel with a great strategic advantage in the north, helping Israel control the Sea of Galilee and the towns and cities on the northern plains of Israel. But as Ettinger explained, few recognize that the mountainous ridge on which Judea and Samaria sit is infinitely more important to Israel than the Golan. It is so important, in fact, that it took less than a month for the Israeli government, after gaining Judea and Samaria in June 1967, to start rebuilding its national security platform around Israel’s control of Judea and Samaria.

Today, the hill country of Judea and Samaria are to Jerusalem, the Dead Sea and the coastal plain, what the Golan is to the Sea of Galilee and Israel’s northern plains. Strategically, the territory of Judea and Samaria is the pivot on which the national security of the Jewish state depends. It is critical not only to the security and stability of Jerusalem and the other towns and cities in the Judean and Samarian hills, but also essential to the security of towns and cities on the coastal plain, on which 80 percent of Israel’s population lives and the bulk of Israel’s finance, economy and transportation arteries and industry exists.

To those who understand the centrality of Judea and Samaria to Israel’s existence as an independent and secure state, the notion of ceding this territory to the Palestinians—a people incapable of forging peace among themselves, let alone with their sworn enemy—in return for peace, is illogical and immoral. Yet that is the basic premise of the two-state solution, a peace plan outlined in the Oslo accords in 1993, which has been embraced by most of the international community, including Britain, the European Union, the Palestinian Authority, and even the Arab League (with preconditions).

Pope Benedict xvi, while touring Israel this week, also called on Israel’s leadership to embrace the two-state solution for peace with the Palestinians. “I plead with all those responsible to explore every possible avenue in the search for a just resolution of the outstanding difficulties, so that both peoples may live in peace in a homeland of their own, within secure and internationally recognized borders,” Benedict said Monday.

The Obama administation is pushing Israel toward the same end. Speaking to reporters at a UN Security Council meeting this week, America’s ambassador to the United Nations Susan Rice stated that the “United States is fully and unequivocally committed to working for a two-state solution,” telling the international media that the Obama administration shares a “sense of urgency” in solving the Israeli-Palestinian conflict. “This is a moment that should not be lost,” she said.

Analysts expect President Obama’s urgency to be apparent next week when Israeli Prime Minister Benjamin Netanyahu flies to Washington, where he will more than likely be pressured to cede Judea and Samaria in the creation of a Palestinian state. Speaking before the American-Israel Public Affairs Committee in Washington last week, Vice President Joseph Biden said that “Israel’s security is non-negotiable. Period. But Israel has to work toward a two-state solution.” America and the rest of the world simply refuse to recognize that these are mutually exclusive realities.

For Israel, the creation of what would assuredly be a Hamas-controlled, Iranian-influenced Palestinian state in Judea and Samaria—the heartland of the Jewish people and key to Jewish national security—would amount to national suicide. This is why we do not expect Netanyahu to give in to demands for a two-state solution.

The issue of harsh interrogation techniques to fight the war on terror has some lawmakers running for political cover these days.

But at least one U.S. senator, New York Democrat Charles Schumer, made the case in favor of possible use of torture five years ago, explaining "most Americans and most senators, maybe all, would say, 'Do what you have to do'" if there were an imminent nuclear threat against the nation.

Speaking before the Senate Judiciary Committee on June 8, 2004, Schumer stated:

"And I'd like to interject a note of balance here. There are times when we all get in high dudgeon. We ought to be reasonable about this. I think there are probably very few people in this room or in America who would say that torture should never, ever be used, particularly if thousands of lives are at stake.

But almost overlooked amid the destruction that the government’s plans are wreaking on the American dollar and the national economy are the dangers encroaching from outside the country. Realizing that America is profoundly weakened by domestic economic problems, opportunistic predators are seizing the chance to lash out at the world’s most prosperous and powerful country.

This is history in the making. Not the good kind of history. More like Nero-fiddling-while-Rome-burned history.

The kind of history we are seeing now is an empire in terminal and rapid decline. Besieged by problems within, facing enemies without, the greatest single nation in history is disintegrating like Rome and dozens of other empires before it.

A movement to reclaim for states all rights not specifically designated to the federal government in the U.S. Constitution is exploding across the nation, with 35 states already acting or at least considering such proposals – and one state lawmaker estimating the nation as a whole could save $11 trillion in coming years if it would succeed.

WND reported not long ago when the number of states with lawmakers considering such sovereignty efforts reached 20.

Now, according to the Tenth Amendment Center, such provisions have been launched in at least 35 states. They all address the Tenth Amendment that says: "powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

South Carolina's S. 424 is an example. It is titled: "To affirm South Carolina's sovereignty under the Tenth Amendment to the United States Constitution over all powers not enumerated and granted to the federal government by the United States Constitution."

The White House has scrubbed President Obama's central pledge to the homosexual community from its website – his promise to quash the federal Defense of Marriage Act.

The president unveiled his pro-homosexual agenda on the White House website on Inauguration Day. Under the "Civil Rights" section, he called for the repeal of the act signed by President Bill Clinton in 1996 after an overwhelming bipartisan vote in Congress (342-67 and 85-14).

The Defense of Marriage Act provides that federal laws must be interpreted in accord with the traditional definition of marriage as the union of husband and wife.

The following is the original language posted on the White House website as Obama took office:

Oppose a Constitutional Ban on Same-Sex Marriage: President Obama voted against the Federal Marriage Amendment in 2006 which would have defined marriage as between a man and a woman and prevented judicial extension of marriage-like rights to same-sex or other unmarried couples.

Support Full Civil Unions and Federal Rights for LGBT Couples: President Obama supports full civil unions that give same-sex couples legal rights and privileges equal to those of married couples. Obama also believes we need to repeal the Defense of Marriage Act and enact legislation that would ensure that the 1,100+ federal legal rights and benefits currently provided on the basis of marital status are extended to same-sex couples in civil unions and other legally-recognized unions. These rights and benefits include the right to assist a loved one in times of emergency, the right to equal health insurance and other employment benefits, and property rights. (emphasis added)

The White House has removed the president's goal to repeal the act. The website now states the following:

President Obama also continues to support the Employment Non-Discrimination Act and believes that our anti-discrimination employment laws should be expanded to include sexual orientation and gender identity. He supports full civil unions and federal rights for LGBT couples and opposes a constitutional ban on same-sex marriage. ... (emphasis added)

The White House also temporarily altered language promising to repeal the military's "Don't ask, don't tell" policy. The newly worded statement simply said the president "supports changing Don't Ask Don't Tell in a sensible way that strengthens our armed forces and our national security."

After Pro Publica caught the change, the White House reinserted the word "repealing" in place of "changing."

JERUSALEM – If Pope Benedict XVI so fervently supports a Palestinian state – which would split sections of Israel – he also should divide Rome, charged the leader of a coalition of more than 350 Israeli rabbinic leaders and pulpit rabbis.

"I was shocked to hear that the first thing the pope had to say when he landed in Israel was that the Holy Land must be divided to make room for a Palestinian state," said Joseph Gerlitzky, rabbi of central Tel Aviv and chairman of the Rabbinical Congress for Peace, which includes some of Israel's most prominent Jewish leaders.

"I suggest that he divide Rome. The Holy Land was promised to the Jewish people and absolutely no human being on this earth has a right to relinquish even one inch of this land," Gerlitzky stated.

Gerlitzky made the remarks at a speech today commemorating the Jewish festive day of Lag Ba'Omer, which is about the mid-way point between Passover and the day on which the Jews were said to have received the Torah.

In his opening comments after disembarking at Israel's international airport yesterday, Benedict called for the creation of a Palestinian state with the hope that Israelis and Palestinians "may live in peace in a homeland of their own within secure and internationally recognized borders."

Gates changes commanders in Afghanistan

US defense Secretary Robert Gates has asked for the top US commander in Afghanistan, Gen. David McKiernan to resign and recommended he be replaced by a former Special Operations officer in Iraq, Lt. Gen. Stanley A. McChrystal.

He made the announcement without explanation at a Pentagon news conference Monday, May 11, attended also by Chairman of the Joint Chiefs of Staff Adm. Mike Mullen.

DEBKAfile's military sources report that the unusual step of changing commanders in mid-war indicates that the situation on the Afghan front is a lot more serious than apparent from official accounts. It may also reflect a sharp difference of opinion between the Obama administration and the high command as represented by Gen. McKiernan.

Western military experts have long been critical of US and British war strategy in Afghanistan. Taliban and al Qaeda manage are rapidly moving in on large stretches of the country, while US and UK units are too slow and cumbersome to cut them off. Their old-fashioned, slow combat techniques give the fast-moving enemy the upper hand.

Required in Afghanistan, say most experts, are small, swift units armed with massive firing power – not unwieldy groups which are lodged in large bases and emerge for forays against the enemy. Taliban and al Qaeda keep track of US troop movements through local informants employed at their bases and so deny them the element of surprise.

Last week, Gates was in Afghanistan and visited the large Camp Leatherneck base under construction in the embattled southern province of Helmand on the Pakistan border. This base is designed to accommodate the 17,000 extra troops Obama has approved for Afghanistan in the summer.

The defense secretary apparently received the impression that Gen. McKiernan was not planning a change in tactics and therefore decided to replace him.

The incoming chief, Gen. McChrystal, currently the director of the joint staff, was forward commander of the US military's covert Joint Special Operations Command from 2006 to August 2008, which was responsible for tracking down and killing al Qaeda leader Abu Musab al Zarqawi in April 2006, as well as high-profile Sunni insurgents.

Gates seems to believe that McChrystal's special operations tactics may succeed better in breaking Talilban-al Qaeda resistance than the more traditional methods of the departing Gen. McKiernan.
